zur Verarbeitung personenbezogener Daten bei der Teilnahme an der e-Learning- und Kommunikationsplattform Moodle an der Innovationsregion Kocher & Jagst e. V.

1. Für die Teilnahme an Moodle werden persönliche Daten von Ihnen erhoben und in einer Moodle-internen Datenbank gespeichert, darunter mindestens die Pflichtangaben Namen, E-Mail, Wohnort, Land, Benutzername und Kennwort, ohne die kein Moodle-Account eingerichtet werden kann. Darüber hinaus können Sie freiwillig weitere Angaben in einem "persönlichen Profil" hinterlegen und abgestuft beeinflussen, welche dieser Daten für andere an Moodle Teilnehmende sichtbar sind. Moodle ermöglicht es Ihnen zudem, unter ihrem Namen Beiträge in Foren, Chats, Blogs, Wikis, Journalen etc. zu veröffentlichen und Dateien für andere Teilnehmende zum Abruf bereitzustellen.
2. Bei der Nutzung von Moodle werden Ihre Beiträge und Aktivitäten in Protokolldateien des Webservers sowie der Moodle-Software gespeichert, soweit das für die individualisierten Funktionalitäten in Moodle erforderlich ist. Weder Kursverantwortliche (z.B. in der Rolle "Lehrende"), noch andere Kursteilnehmende (z.B. in der Rolle "Studierende") haben Zugriff auf diese Nutzungsdaten. Kursverantwortliche (in der Rolle "Lehrende") haben Zugriff auf sogenannte Aktivitätsübersichten zu Zwecken der Lehrvermittlung, der Lehrorganisation und der Lehrerfolgskontrolle im betreffenden Kurs. Dargestellt werden hier persönliche Beiträge zu Aktivitäten wie Foren, Wikis, Blogs oder Aufgaben. Diese Daten dürfen ausschließlich für Lehrzwecke verwendet werden, soweit dies zur Aufgabenerfüllung erforderlich ist und die Datenverarbeitung vor dem Hintergrund des Datensparsamkeitsprinzips in angemessenem Verhältnis zu dem mit ihr verbundenen Zweck steht.
3. Die mit der technischen Verwaltung des Moodle-Systems (z.B. in der Rolle "Administrator") sowie des Datenbank- und Webservers betrauten Personen haben Zugriff auf alle im System gespeicherten personenbezogenen Daten. Sie dürfen diese Daten ausschließlich insoweit verarbeiten, wie dies zur Gewährleistung des Betriebs von Moodle erforderlich ist, und sind gesondert schriftlich auf das Datengeheimnis verpflichtet worden.
4. Ihre personenbezogenen Pflichtangaben werden ausschließlich für Ihre Teilnahme an Moodle-basierten Lehrveranstaltungen verarbeitet. Die Erhebung, Speicherung, Nutzung oder Weitergabe darüber hinaus gehender personenbezogener Daten in Moodle erfolgt auf Basis einer Einwilligung in elektronischer Form. Die in Moodle verarbeiteten personenbezogenen Daten werden vorbehaltlich gesetzlicher Bestimmungen nicht an Dritte weitergegeben oder für andere als die vorgesehenen Zwecke verwendet.
5. Die im Rahmen des Zugriffs auf Moodle-Kurse gespeicherten Nutzungsdaten werden automatisch nach 180 Tagen gelöscht. Ihren Moodle-Account mit den Pflichtangaben können Sie jederzeit auf Antrag bei der Geschäftsstelle der Innovationsregion Kocher & Jagst e.V. löschen lassen. Von der Löschung und dem Widerruf ausgenommen sind von Ihnen in Moodle veröffentlichte Beiträge in Foren, Chats, Blogs, Wikis, Journalen etc. bzw. zum Abruf bereit gestellte Dateien, die bis zur Löschung des jeweiligen Moodle-Kurses verfügbar bleiben. Nach Wegfall des Verarbeitungszweckes ist vom Kursverantwortlichen eine vollständige Löschung des Kurses bei den Moodle-Administratoren zu beantragen.
6. Eine Veröffentlichung von Moodle-Kursen zu Präsentationszwecken ist ausschließlich durch das Exportieren der im Kurs enthaltenen Daten ohne Nutzerdaten in einem neuen Kurs zulässig. Personenbezogene Daten sind vor der Veröffentlichung aus den Kursinhalten zu entfernen bzw. zu anonymisieren. Für die Präsentation von Teilnehmerbeiträgen ist die Zustimmung der Teilnehmer erforderlich.

on the Processing of Personal Data for the Use of the E-Learning and Communication Platform "Moodle" at Innovationsregion Kocher & Jagst e. V.

1. For the use of Moodle personal data will be registered and stored in an internal Moodle database. Name(s), email address, residence, country, user name and password are mandatory entries because without them no Moodle Account can be set up. In addition and voluntarily, further data can be entered in a "personal profile" with the owner of the account being able to decide which other Moodle users have access to the various levels of the profile. Moodle also enables the owner of an account to publish personal contributions to forums, chats, blogs, wikis, journals, etc., or make personal files available for other users.
2. When using Moodle, the account owner′s contributions and other activities will be stored as protocol files of the web server and Moodle software as required for the individualized Moodle functions. Neither teachers (teaching staff) nor course participants (students) will have access to these log data. Access of teachers is restricted to general activity reports solely for the purpose of organizing, controlling and evaluating the teaching and learning process. These reports contains of individual contributions of the user to activities like forums, blogs, wikis etc. They are to be used exclusively for teaching purposes. Processing of data has to be economical and in line with the specific purpose.
3. Persons involved in the technical administration of the Moodle system, the database and the web server have access to all log data stored in the system. They may solely process these data as far as required for the operation of the system. They are legally bound to uphold data secrecy.
4. Mandatory personal data entered into the system will be processed only for participation in Moodle-based teaching. The registration, storage, use and transfer of further personal data within Moodle is based on consent given electronically. Personal data processed in Moodle will not be disclosed to third persons or for other non-specified purposes subject to the relevant legal regulations.
5.User data stored while working with Moodle courses will be erased automatically after 180 days. Moodle accounts and the mandatory data attached to them can be erased at the user′s request by the operators of the Office at Innovationsregion Kocher & Jagst. Consent to processing data other than the mandatory ones can be revoked by an email sent to the administrators. It should be noted, however, that personal contributions published in forums, chats, blogs, wikis, journals, etc. as well as files entered into system to be used by other persons cannot be revoked or erased. They will be available until the respective Moodle course is erased. By the time a course is no longer required the teacher is expected to apply for a complete erasure with the Moodle administrators.
6. The publication of Moodle courses for presentation purposes is allowed only by exporting the course data without any user data into a new course. Any personal data included in the course material are to be removed completely or made anonymous before publication. The inclusion of contributions of course participants into a presentation requires the consent of the individuals concerned.
